§ 62-52. Snow conditions.

  • (a)

    Snow emergency declaration. In the event the village manager or superintendent of public works shall declare a snow emergency due to the falling of an unusual volume of snow, it shall be unlawful for any person to park or abandon or suffer to remain parked any vehicle on any street, road or highway in the village during the period of the snow emergency, as set for the official declaration of the same. In the event an automobile is stalled during or immediately prior to such snow emergency, it shall be the duty of the owner of such vehicle to remove the same from any street, road or highway in the village on which such vehicle may have become stalled within a reasonable time after the same has become stalled. If such vehicle is deemed by the police department as being an obstruction to the free movement of traffic, the department may order the vehicle towed to the police station and the vehicle owner shall pay the costs of such towing.

    (b)

    The operator of any vehicle that is not a snow plow may not follow a snow plow closer than 200 feet upon any highway having a posted speed limit of more than 35 miles per hour, if the snow plow is engaged in highway winter maintenance snow and ice removal, and is using headlamps, and may not follow a snow plow closer than 150 feet upon any highway having a posted speed limit of 35 miles per hour or less, if the snow plow is engaged in highway winter maintenance snow and ice removal, and is using headlamps. This subsection does not apply when legally overtaking and passing a snow plow, but the fact that the operator of any vehicle is following more closely than the distance as herein prescribed is prima facie evidence that the operator is violating this section. This section does not apply to a snow plow that is stopped or standing in the highway.
